Terms and Conditions

The rules for hosting an event on GiftNest and for contributing to one, in plain language.

1. About these terms

GiftNest is an event gifting service run by New Wave Technologies, Kampala, Uganda ("GiftNest", "we", "us"). These terms apply to everyone who uses it: hosts who create events, the co-hosts they add, and guests who leave messages and contribute.
By creating an account, or by contributing to an event, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use GiftNest.

2. Accounts

  • You must be 18 or older to create an account. Guests do not need an account to contribute.
  • The details you give us must be true and kept up to date, including your name and phone number.
  • You are responsible for everything done with your account. Keep your password private and tell us at once if you think someone else has used it.
  • An account is for one person. Co-hosts get their own accounts when an event's Owner adds them.

3. Hosting an event

When you create an event you are its Owner. You decide what it says, which gifts it lists and who helps you run it. You agree that:
  • the event is real, and you are one of the people it celebrates, or are organising it with their knowledge;
  • the gifts and cash funds you list are what you will use the contributions for, and you buy the gifts yourself: GiftNest does not sell, buy or deliver anything;
  • you only add people to your guest list, and send them SMS, when you have a reasonable basis to contact them;
  • everything you publish (names, photos, stories) is yours to share and does not break anyone else's rights.
You may close your event at any time. An event that has received contributions stays on record, because it is part of the guests' receipts.

4. Contributions

Guests contribute money towards gifts and cash funds that the hosts will buy or use. A contribution is a gift to the hosts. It is not a purchase from GiftNest and does not entitle the guest to goods, a service or a share of anything.
  • Amounts are in Uganda shillings (UGX). Each event sets the smallest contribution; a larger amount can be contributed over more than one payment.
  • A guest may choose to hide their name from other guests. The hosts always see who contributed, so they can say thank you.
  • A contribution is complete only when the guest approves the payment on their phone and the payment provider confirms it. Every completed contribution gets a reference and a receipt.

5. Payments

Payments are made by MTN Mobile Money and Airtel Money through our payment partner, OlyCash. The guest approves each payment on their own phone with their own PIN; GiftNest never sees or stores a PIN.
Any fee the payment provider charges is shown before the guest approves. GiftNest is not responsible for delays or failures caused by a mobile network or the payment provider, but we will help put right any payment that was taken and not recorded.

6. Withdrawals

Contributions are collected into GiftNest's merchant account with our payment partner. Each completed contribution is credited to the account of the event's Owner, the Event Manager who created it, and listed under Transactions with their account number (it begins GNA). GiftNest keeps one record of every movement of money on an account. Records are never edited: a correction is entered as a separate Adjustment that states its reason.
To be paid, the Event Manager adds a Payment Method (a Mobile Money number, or a bank account with its bank and branch) and makes a Withdrawal Request, either from their Available Account Balance or from one event's Available Event Balance. The Available Balance is what has been contributed, less what has already been withdrawn and any request still pending, and does not include money on a suspended event. Only an event's Owner can withdraw from it; co-hosts cannot.
  • A GiftNest administrator pays each request outside GiftNest to the Payment Method it names, then records the Amount Paid, the Payment Reference, the Payment Date and a Payment Proof. The Event Manager is told in the dashboard, by email and by SMS when a request is paid, or rejected with the Rejection Reason.
  • The cost of sending the money is the Withdrawal Fee. It is taken from the Requested Amount and shown on the request and in Transactions, so the Amount Paid and the Withdrawal Fee together never exceed what was requested.
  • A request can be cancelled while it is still Pending. An administrator cannot pay their own request.
  • Before paying, we may ask the Event Manager to confirm their identity and their Payment Method. We may hold or reject a request while we look into a suspected fraud, a reported scam or a disputed payment, and we will say why. Money on a suspended event cannot be withdrawn until the event is released.
  • The Event Manager is responsible for adding a Payment Method that is correct and that they are entitled to use. Money sent to the details they provided is treated as paid.

7. Refunds and mistakes

Contributions are final once approved. If a guest was charged twice, charged the wrong amount, or paid for an event that was taken down, they should write to us within 14 days with their GN- reference. Where we confirm the mistake we refund the paying number, less any fee the payment provider does not return.

8. Acceptable use

You must not use GiftNest to:
  • create a fake event, pretend to be someone else, or collect money under false pretences;
  • move money for any purpose other than the celebration shown, or launder money;
  • send SMS or messages that are unwanted, abusive, misleading or unlawful;
  • post content that is hateful, obscene, defamatory or that breaks the law of Uganda;
  • interfere with GiftNest, probe it for weaknesses, or reach data that is not yours.

9. Suspension and closure

We may suspend an event or an account, without notice where needed, if we reasonably believe it breaks these terms, puts guests at risk, or is the subject of a credible report. A suspended event cannot take contributions and its guest page is offline. We tell the hosts the reason and how to reach us.
You may stop using GiftNest at any time. Records of contributions are kept as our Privacy Policy describes.

10. Your content and messages

Hosts keep ownership of what they publish, and guests of the messages they write. You allow GiftNest to store and show that content for the purpose of running the event. Hosts may hide or delete wishes on their event; we may remove content that breaks these terms.

11. Our service and its limits

We work to keep GiftNest available and accurate, but it is provided as it is, and it may sometimes be unavailable for maintenance or for reasons outside our control, such as mobile network outages.
To the extent the law allows, GiftNest is not liable for indirect or consequential losses, or for what hosts do with the contributions they receive. Nothing in these terms limits any right you have under the law of Uganda that cannot be limited.

12. Changes to these terms

We may update these terms as GiftNest changes. We will post the new version here with its effective date and, for changes that matter, tell account holders by email or in the dashboard. Using GiftNest after a change means you accept the updated terms.

13. Law and disputes

These terms are governed by the laws of the Republic of Uganda. We will try to settle any disagreement with you directly first; if that fails, the courts of Uganda will decide it.
